Welcome to ResumeFixer AI. These Terms of Service ("Terms") govern your access to and use of our resume optimization service ("Service"). Please read these Terms carefully before using our Service.
By creating an account, accessing, or using ResumeFixer AI, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
1. Acceptance of Terms
By accessing or using ResumeFixer AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 18 years old to use this Service. By using the Service, you represent that you are at least 18 years of age.
2. Service Description
ResumeFixer AI is an Applicant Tracking System (ATS) resume optimization service that:
- Analyzes resumes for ATS compatibility and calculates ATS scores
- Optimizes resume content using artificial intelligence (Google Gemini AI) to improve keyword matching and formatting
- Provides improvement suggestions including keywords, metrics, action verbs, and formatting recommendations
- Processes resume files (PDF and DOCX formats) and job descriptions to generate optimized versions
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. User Accounts
3.1 Account Creation
To use our Service, you must create an account by providing:
- A valid email address
- A secure password
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Email Verification
You must verify your email address before you can use the Service. We will send a verification code to your email address. You are responsible for maintaining the security of your email account.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password
- Notify us immediately of any unauthorized access
- Log out of your account when using shared devices
- Not share your account credentials with others
3.4 Account Responsibility
You are solely responsible for all activities conducted through your account, whether authorized by you or not. We are not liable for any loss or damage arising from unauthorized use of your account.
4. Acceptable Use Policy
You agree not to use the Service to:
- Upload, transmit, or process any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Upload resumes or job descriptions containing false, misleading, or fraudulent information
- Violate any applicable laws, regulations, or third-party rights
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service for any commercial purpose other than personal resume optimization without our written consent
- Upload files containing viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
Violation of this Acceptable Use Policy may result in immediate termination of your account and access to the Service.
5. Subscriptions and Payment
5.1 Plans and Optimisation Limits
Usage is governed by plan-based optimisation limits. One optimisation equals one full job-specific resume generation. ATS score checks and feedback are not limited for any plan.
- Free: One optimisation total (lifetime). After that, you can still run ATS score checks and view feedback; full optimised resume generation requires an upgrade.
- Paid (Monthly / Quarterly / Annual): A set number of optimisations per billing period (e.g. 10, 30, or 150 depending on plan). Optimisations reset on renewal. Full results including optimised resume HTML, ATS scores, and improvement suggestions.
- Top-ups: One-time purchases that add extra optimisations for your current billing period only. Top-ups do not extend your plan end date and are discarded on subscription renewal or cancellation.
5.2 Payment Terms
Pro tier subscriptions are billed in advance for the selected billing cycle (monthly, quarterly, or annual). You agree to pay all fees associated with your subscription.
All fees are non-refundable except as required by law or as specified in our Refund & Cancellation Policy.
5.3 Subscription Changes
You may upgrade, downgrade, or cancel your subscription at any time. Changes to your subscription will take effect at the beginning of your next billing cycle, unless otherwise specified.
5.4 Automatic Renewal
Pro tier subscriptions automatically renew at the end of each billing period unless cancelled. You are responsible for cancelling your subscription before the renewal date if you do not wish to continue.
6. Intellectual Property Rights
6.1 Service Ownership
The Service, including all content, features, functionality, design, and technology, is owned by ResumeFixer AI and protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain ownership of any resumes, job descriptions, and other content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to:
- Process and analyze Your Content to provide the Service
- Temporarily store Your Content on our servers during processing
- Use Your Content to improve our AI algorithms and service quality (in anonymized form)
6.3 Optimized Content
The optimized resume content generated by our AI service is provided for your use. You own the optimized content and may use it for your job applications. However, you are responsible for reviewing and verifying the accuracy of all optimized content before use.
7. AI-Generated Content
Our Service uses artificial intelligence (Google Gemini AI) to optimize your resume. Important disclaimers:
- Accuracy: While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing and verifying all optimized content before use.
- No Guarantees: We do not guarantee that optimized resumes will result in job interviews, job offers, or improved ATS performance.
- Factual Integrity: Our AI is designed to maintain factual accuracy and not invent skills, experiences, or qualifications. However, you must verify all information in the optimized resume.
- Your Responsibility: You are responsible for ensuring that your resume, including optimized versions, contains only truthful and accurate information. Misrepresentation in job applications may have legal consequences.
8. Disclaimers and Limitations
8.1 Service Availability
We do not guarantee that the Service will be available, uninterrupted, error-free, or secure. The Service may be subject to scheduled maintenance, updates, or technical issues.
8.2 ATS Score Accuracy
ATS scores are estimates based on our algorithms and AI analysis. Actual ATS system behavior may vary. We do not guarantee that our scores accurately reflect how any specific ATS system will process your resume.
8.3 Third-Party Services
Our Service relies on third-party services (Google Gemini AI, hosting providers). We are not responsible for the availability, performance, or actions of these third-party services.
8.4 No Professional Advice
The Service provides automated resume optimization. It does not constitute professional career advice, legal advice, or recruitment services. You should consult with appropriate professionals for career or legal guidance.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMEFIX AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Loss of job opportunities or career advancement
- Costs of substitute services
- Damages resulting from use or inability to use the Service
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting us at support@top10impact.com or through your account settings. Upon termination, your access to the Service will cease, but you will retain access to your account and remaining optimisations until the end of your current billing period (for paid subscribers).
10.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you:
- Violate these Terms or our Acceptable Use Policy
- Engage in fraudulent, illegal, or harmful activities
- Fail to pay required fees (for Pro tier)
- Use the Service in a manner that harms us or other users
10.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ResumeFixer AI operates, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, as determined by applicable law.
